Terms and Conditions

Definitions

"Charterer" (hereinafter called "the Charterer") the organiser of the cruise to include an individual, individuals, group, company or other association, or group of people of whatever description.

"Part Two Charters" (hereinafter called "Part Two") the business name of the boat supplier registered with the Companies Registration Office.

  1. A 50% deposit shall be paid by the Charterer within 7 days of the date of confirmation of the booking and the balance shall be paid in full prior to departure. A booking form shall be signed by the Charterer at the time of confirmation upon which the date of the cruise and the duration of same together with the agreed price shall he clearly stated.

  2. The price as agreed between the parties shall include skipper / crew and fuel for the charter together with wine and savouries or tea / coffee and biscuits and will be clear from the face of the booking form.

  3. Should the duration of the charter be longer than what was originally agreed between the parties the extra time will be charged to the Charterer pro rata to the price per hour rate as agreed.

  4. In the event that a Charterer wishes to hire the boat for long distances or long usage, the costs of fuel shall be agreed at the time of booking.

  5. Any extraordinary charges which may arise due to a Charterer's special request shall be agreed at the time of booking.

  6. VAT will be added to the cost of the cruise at the current rate.

  7. All cruises commence at the exact time for which the booking is made. Each Charterer is obliged to ensure that all members of the Charterer's party arrive on time as Part Two shall depart on schedule and shall not be responsible for late arrivals,

  8. A full day charter shall be considered as 8 hours.

  9. In the event of cancellation by the Charterer no refund shall be forthcoming if the cancellation is made within two weeks prior to the departure date. In the event of cancellation by the Charterer more than two weeks prior to the departure date a refund shall only be forthcoming if the vessel is capable of being rechartered by Part Two for the relevant date.

  10. In the event that Part Two cancels a charter due to mechanical failure, Part Two shall reasonably endeavour to supply an alternative vessel on the same date or on an alternative date but should this not be possible. a full refund shall be made available to the Charterer.
    In the event that Part Two cancels a charter due to unsuitable weather conditions an alternative suitable date shall be arranged by Part Two and no refund shall be forthcoming.

  11. Part Two shall be exempt from all liability in respect of any delay, loss, expense, damage, sickness or injury of whatever kind and wherever and whenever occurring and however and by whomsoever caused of or to any passenger or any child travelling with any such passenger or in his or her care, damage to any property, goods, articles, matter or things belonging to or carried by or with or for any passenger or any child.

    The above exemption from liability shall equally apply to any water sports undertaken by any passenger. The Charterer and any person within his party shall obey all reasonable instructions from the skipper / and or the crew of the vessel whilst on the vessel or engaged in any leisure activities in connection with the vessel such as water sports,

  12. If any passenger for any reason whatsoever suffers including, but not limited to, sickness, injury bodily or mental, intoxication, or reasonably appears to the skipper or his agent to be unfit to proceed or likely to endanger the health or safety on board or likely to impair the reasonable comfort or safety on board then in such case the skipper shall be entitled at his absolute discretion to refuse to embark such passenger and in the event that the passenger is refused embarkation the skipper shall not be liable for any loss or expense occasioned to the passenger nor shall the passenger be entitled to any refund of the fare. However Part Two shall be at liberty to refund such part of the fare as it may in its absolute discretion think fit.

  13. The Charterer shall indemnify Part Two in respect of any claim, loss or expense incurred or damage caused as a result of any direct or indirect act of negligence, omission or rnisbehaviour on board the vessel by the Charterer or any member of the Charterer's party.

  14. Smoking is prohibited in the interior of the vessel at all times.

  15. Each of the provisions contained in these conditions shall be severable and if any of such provisions shall be invalid, illegal or unenforceable the remaining provisions shall nevertheless have full force and effect,

  16. Any dispute arising in respect of these terms and conditions shall be governed by the courts of the Republic or Ireland.
